Whose data we collect

We collect data from people who use this guide, enquire about or book Penthouse 1636, and stay with us.

What we collect

• Enquiry form: your name, email address, preferred dates, number of guests and any message you choose to write.
• Booking and stay: the details you give us or Booking.com when you book, such as names, contact details, and arrival and departure times, and payment records. During your stay we may also hold messages you send us (for example by WhatsApp) and the identity details we are legally required to collect for guest registration in Spain.
• Correspondence: if you contact us, we may keep a record of it.
• Technical data: like most websites, our hosting provider’s servers may log technical information such as your IP address, browser type and the pages you visit, for security and system administration.

How and why we use it

• To reply to your enquiry, check availability, send you an invoice and take your booking (to take steps at your request before a contract, and to perform our contract with you).
• To manage your stay, including sending your arrival details on the day of arrival (performance of our contract).
• To meet legal duties, including guest registration with the Spanish authorities and keeping accounting records (legal obligation).
• To keep this guide secure and working properly, and to protect our property and other guests (legitimate interests).

We do not send marketing emails unless you ask us to. We do not sell your information, and we do not disclose it to advertisers.

Cookies and similar technologies

This guide does not use advertising or tracking cookies, and we do not currently use analytics software. To make the guide work well on your phone it stores a small amount of information on your own device: your chosen price currency (£ or €) and saved copies of the pages so they load quickly and work with a weak signal. This stays on your device and is not sent to us. You can clear it at any time in your browser settings.

If we add analytics or online booking software in future, we will update this policy and ask for your consent where the law requires it.

Who we share your information with

We only share personal data where necessary, with:

• our web hosting and email providers, who host this guide and deliver your enquiry to us;
• Booking.com and WhatsApp, where you book or communicate with us through them (they have their own privacy policies);
• our cleaners and property managers, for changeover and arrival arrangements, only as far as needed;
• the Spanish authorities, where the law requires guest details to be registered;
• our professional advisers, accountants and payment providers, where needed;
• anyone else where we are legally required to, or to protect the rights, property or safety of ASKC Properties Ltd, our guests or others; and a buyer of our business or assets, if we ever sell it.

Where your data is stored

Your data may be processed and stored outside the UK and the European Economic Area, for example by providers such as Booking.com or WhatsApp. Where this happens we take reasonable steps to make sure it is protected in line with this policy and data protection law.

Security

Information you send through this guide is transmitted to us by email. Please note that transmission over the internet is never completely secure. We use reasonable measures to protect your data, but any transmission is at your own risk. Please do not put payment card or bank details in the enquiry form.

How long we keep it

• Enquiries that do not lead to a booking: up to 12 months, unless you ask us to delete them sooner.
• Booking and payment records: up to 6 years, to meet UK tax and accounting requirements.
• Guest registration details: for as long as Spanish law requires.
• Technical logs kept by our hosting provider: for a short period, in line with their policy.

We may keep information for longer where there is an unresolved issue (for example an unpaid invoice or a damage claim), where we are required to by law, or in anonymised form.

Your rights

You have the right to:

• ask for a copy of the personal data we hold about you (a “subject access request”), which we will provide free of charge, although we may charge a reasonable fee for repetitive, unfounded or excessive requests;
• ask us to correct inaccurate data;
• ask us to delete your data, where it is no longer needed or was processed unlawfully;
• ask us to restrict how we use your data, for example while its accuracy is disputed;
• object to processing based on our legitimate interests, and to any direct marketing;
• receive your data in a commonly used, machine-readable format (such as .csv) to give to another organisation; and
• withdraw your consent at any time, where we rely on it.

To use any of these rights, email us at info@askcproperties.com or write to the address above. We will usually reply within one month. You also have the right to complain to the UK Information Commissioner’s Office (ico.org.uk) or to the data protection authority where you live.

This guide links to other websites, such as maps, local attractions, the golf club and tourism sites. They have their own privacy policies and we are not responsible for them. Please check them before you share any personal data.

Any changes will be posted on this page, with the date updated at the top.
